Hello, my friend is currently incarcerated with a release date coming
soon. He was incarcerated for DUI related charges, which I don't
believe were removable offenses. About a decade ago, he was legally
married and in process of obtaining his Green Card. All of the apps
were filed, and ready to go on the day he showed up to receive the
card....however his wife never showed up to sign the card that day,
and the app was considered "abandoned" on the spot. We have been
told by a lawyer that if the card was ready to go on that day, and
all he needed was a signature, then the card is valid. This is a
confusing situation.
Would he be allowed to file an application for renewal/replacement?
We have filed paper work with the FOIA to find his original
application, but this could take a year to get any information. What
are his options? He has since been divorced, but has two USC
children, and proof of length of marriage. Any suggestions, or
information would be greatly appreciated.
