    Okay here is my situation,

    My wife is from Paris, France. We met while i was in europe dated for years and got married in October in Philadelphia. She was in the country on a tourists visa through the VWP (Visa Waiver Program) and i preposed to her spontaniously. We then did a civil service ceremony.She arrived in August so are marriage was during the ninty days she was legally allowed in the country. We then got all the papers to file for her adjustment of status and to get her green card. It took a long time to get all the papers ready and we sent them out in mid Febuary after the ninty days had expired. On March first we got a call from her aunt saying that her mother suffered a brain anurism and was in a coma and would not make it. We immidiatly left the country to go to her native France. Her mother passed away the day we got there on March 1, 2008. We were told at the airport when we left the country that she had over stayed her visa and could not purchase a round trip ticket coming back. Since we left the country all the papers we filed are void but the I130, which is sitting in Missouri at the National Benefit Center at the bottom of a huge pile. Our life is in america she has no job in France and I dont speak the language, but i cant possible leave her alone here at a time like this. However my job in America wont be waiting for me much longer.

    The I130 wont be approved for several months how can I bring my wife back into the country? I tried re filing at the American Embassy in France and was told i could not do that unless I was a legal resident of France for six months.

    Please if anyone knows anything I can do to bring my wife back to our home in the US, let me know ASAP. I am really stuck here and am desperate for anything.

    I am 24 and my wife is 23 her mother and her were extremely close and her father deserted her family when she was 16 so im all she has.. PLEASE HELP ME GET HER HOME

      If she left without an approved Advance Parole (i131) like you said, then her adjustment of status is void. She can not travel under the visa waiver program (which is different than having a visitor visa) because she overstayed.

      All she can do is wait. Wait until the I-130 is approved.

      Research on k-3 visa and consular processing.
