  • Can anyone know what to do?Please read!

    My mother just got immigrant visa through me(I am an us citizen).I have a sister and she is going to be 21 this coming December. I made a mistake and didn't add my sister with my mother immigrant visa petion even though she is in her document as a doughter.Is there anyway my mom can claim right now that she wants to take her daughter (since she is under 21) with her and come to us? Please help if anyone know how to add her with my mother visa. Thanks

    Immediate Relatives of US Citizens (Parents) can not have dependents. Your sister CAN NOT be added to your mom's petition. You have to file for her separately, and it will take 15+ years for her to get a visa.

      But I heard Children under 21 can come with parents.Is it true or it fall into diffrent catagory?

        She's not your kid, she's your sister, which falls under 4th category of FB. Per visa bulletin ... cut-off date is 22JUL97 for ROW

          Children under 21 can accompany parents only for the categories for which visas are limited, such as F1, F2, F3, F4.

          Your parents come under IR category. Therefore, you sister can't accompany your parents, even if she is under 21.

            I don't know why you say that she cannot come with her parents even though she is under 21.I called INS and spoke with rep and she told me children under 21(unmarried) can come with parents.She told me get info pass to my local INS office and talk with immigration officer so if they can fix since I didn't do petition for my sister under my mother visa petition.

              You need to do that then. If you will not listen to our advice. Go on and try it your way.

              But, it is a FACT, that when you sponsor your parents... they can not bring your minor siblings... it is as simple as that.

                What is IR category?One of my friend came with her parents but it was diversity visa and the time my friend came he was under 21.Is it because of catagory?I'm just confuse sorry!

                  Family Based Categories CAN have dependents...

                  IR = Immediate Relatives. Such as your parents and they can not have dependents.
