IF both parents are GC holders and kid is born in India.

  • IF both parents are GC holders and kid is born in India.

    Hi all,

    Both the parents are US GC holders and they have taken re-entry permit for 2 yrs since they got transferred to India office. And if they have a kid born in india. Now they are entering US before expiring their Re-entry permit. On what visa should they get for their kid? weather the kid is elligible to get GC? or Ho long does it takes to get GC for the infant kid?

    If the child is under 2 years old, entering US for the first time along with their parents who are GC holders and the parents are not inadmissible, the child gets a I-181 landing record and GC thereafter by a stamp on the passport. Alien number is assigned at POE.

      But I didn't get this, what do you mean by "the parents are not inadmissible"?

      and also do we have to get H4 visa for our kid while starting from India?

        General rules for inadmissiblility apply for anyone at POE. No criminal record, not given up the GC etc. No visa is needed for the child.

          sons visa

          me and my wife came to usa in 2006 sept. we left our son in india thinking that we can bring him later.he didnt get the visa, we were under ex category
          now when i contact chennai visa councill, they said no visas available and we should wait till priority date become current.our priority date is 2005 and current is 2002, plesae advise me what to do....i have only one son
          can i apply visiting visa?what is v visa? how can i bring him

            but now he is 3. 1/2 years old.but now we are planning our first trip to india.chennai embassy people told if its 2 years we can bring him,but now its toolate,and they put him under the waiting list , which wait till priority date become current
            my sons case may be 3-5 years
            at the time of intetrview we talk this matter to counsillar, and he agrees to take him later, but we dont know its 2 years.

                  You need to provide clear explanation of what your case is as your post does not.

                  If a child of PR is not in US before reaching 2 and was born outside US, the child cannot get GC at POE but has to go through the wait process.
