GC for step daughter

  • GC for step daughter

    need help with an advise. we need to apply for GC for my step daughter (Canadian citizen 15 years old).
    I'm a US citizen and my husband is a GC holder.
    It was easy for my to make his papers, he had a H1B visa before, however, I'm confused with hers.
    do I need to follow the same process?

    Is she in Canada or in the USA? either way, it all starts with I-130.

      she's moving with us next week. she has a ITIN no.
      i don't know if this is going to help some way or not.

        She can not "just move"... she needs an immigrant visa. What visa is she planning on using to enter? visitor? none? either way that would be immigration fraud.

          as a Canadian citizen, she doesn't a need a visa.
          she used to "live" here, in US, two months a year during the summer break, and now she decided to continue her school in us.
          are we going to have any problems if we start "working" on her papers with her in US?

            as a canadian, she does not need a visa to VISIT TEMPORARILY.

            she does need a visa if she plans to immigrate. and yes, she will run into trouble, because the intention already exists... she can not just come and live here. And by all means not "decide" to study in the USA... who do you think pays for that?

              she's in high school, so nothing to pay...yet.
              so yr advice is to start working on her GC with her in Canada, not in US.
              besides I130, does she need a I864 and I485 + medical papers...or something else?
              we know her intentions for months, and i feel guilty because we didn't do anything until now.
