    Dear Legal Adviser(s)

    if immigartion officer tell me that we are putting you on removal process and
    says you will receive immigration court hearing in couple of months, can i still
    switch to a approved labor ( if a company offers they have a approved labor).

    No legal advisors here, nor in any other public forum...
    You'd have to pay a lawyer to get legal advise.

    In particular, since you are facing deportation, you should seek the help of an experienced immigration lawyer ASAP.

      how can one check that lawyer is good , other than by price?

      was working on h1b , applied for extension 2 months before it
      got expired. got query from INS asking why not followed 30
      day follow-up registration interview , (reason officer at airport
      told its getting suspended so dont worry) which later on law
      for special registration got suspended in dec 2003.
      but my 30 day period ended in july 2003, listend to
      immigration officer and did not go for 30 day
      follow-up registration ( very very big mistake). even though i
      had registered with ins/nseers at least 4 times prior )
      based on this immigration officer put charges that i can not
      work anymore. and will hear from court for hearing.

      my questions>
      1) am i illegal ?
      2) can i work ?
      3) can i switch to approved labor though my application for
      extension of h1b is in approval process?

        Your situation is so special that I doubt anybody here or on any other public forum can give you an answer, other than: you need a lawyer.
        You need to get the deportation issues cleared up, anything else is secondary and can wait.
