Apologies for the length of my question but I wanted to provide all the info...
I am married to an US citizen and petitioned and was granted a 2 year conditional CG. I then petitioned to removed the conditions in Oct 2005 and have been waiting for adjudication on my case since then. On Wed this week, I made an infopass appointment to inquire about the status of my case. I was not ready for an interview because I did not know that I would be interviewed.
Here is my problem, I was told to appear before an officer on Friday next week with proof of our marriage. I moved from the original state where I initially filed my application and the case was moved to where I am currently leaving. When I moved to the new state I did not get that state's DL and still have my maiden name and my petition was filed under my husband. I am no longer with my husband and obviously cannot attend the interview with him. I entered the marriage in good faith but left because of his infidelities and been taken advantage by his family. They waited for me to leave the country in Sept 2005 to go home for my brothers funeral and decided to open all this credit card accounts in my name without my knowledge. It seems like the whole family was leaving off of me and I got tired.
To make the long story short, I can't go for the interview and commit fraud under oath. I am thinking about withdrawing the petition but I am afraid that they will come after me for marriage fraud (which was not my intention) and might issue a deportation notice. I have started divorce proceeding and wondering if they issue a deportation notice, can I still re-marry and petition using my partner and not have to leave the country? I have a 5yr old daughter born in the US from a previous relationship and have been in the US for 13 years,
