  • F-1 and H-1B Fiancee.

    I came in the USA in 2000 on an F-1 visa and attended college until my Junior year. I wasn't able to complete my 4-year course and dropped out of college in 2003 due to financial hardship. Since then till now i have been here illegaly. I'm a about to propose to my longtime girlfriend who is on an H1B visa. My lawyer told me that that's the only option and then i can go back to my original country so that i can readjust my status since my goal to enroll back in college and finish my education.

    My questions are:

    1) if we get married here; can i adjust my status in the USA?
    2) if we get married in my country will it be hard to re-enter the USA, will i need any specific documentations to take to embassy?
    3) What is your advise?

    You need a new lawyer cos the one you have doesn't seem to know the basics of law. You are subject to a 10 year ban.

      What would you suggest? What type of a lawyer would you suggest? Is it possible to avoid the 10 year ban? Clearly i had to drop out of school because of financial hardship. Secondly when my SEVIS was cancelled the school advised to go to the canadian border to get a new stamp, which i did but still the school woudn't enroll me because of money balance. I fought hard and really had no means of income.

      I know of my friends whom their spouse qualify for a J visa after marriage to H1B person; is that possible in my case?

        Immigration lawyer. You don't have a means to escape the 10 year ban unless you marry a USC.
