    Hi I have a couple of questions regarding below statement. Would appreciate if anyone with experience could help. Thank you!

    Birth Abroad Out-of-Wedlock to a U.S. Citizen Mother: A child born abroad out-of-wedlock to a U.S. citizen mother may acquire U.S. citizenship under Section 301(g) INA, as made applicable by Section 309(c) INA if the mother was a U.S. citizen at the time of the child's birth, and if the mother had previously been physically present in the United States or one of its outlying possessions for a continuous period of one year.
    1. if other conditions met, and the mother was naturalized in July 2004, is her abroad born child eligible for acquiring a US citizenship through birth?

    2. As for the "continuous period of one year", does the time spent in US prior to naturalization under permanent residency count?

    1. Based on your post it seems that the mother receved her citizenship thru naturalization, I though that for naturalization you needed to show 5 years of continous residency.

    2. To show continous residence she must have lived in the US 5 years.

    I do not believe continous residency applies to countinous residency as a US citizen... but to get legal help.

      Not familiar with that one year clause. My son was born overseas and I (father not mother) had to show residence in the US for 5 years (3 before age 14, and 2 after). Regardless, I doubt the time she spent in the US prior to naturalization would count.

      After re-reading that clause, I suppose you could show all 5 years after the age of 14. That would have been easier than trying to dig up documents for before the age of 14 (in my case).
