    I need help. I am not sure if I am in the right session. Please pardon me if I am not.

    My wife and I got married in our home country, Taiwan. We got our GC via I-485 together as a married couple.

    Three years later, things aren't working out. We are going to file divorce in Taiwan. Since we are still residence of California, what do I need to do to remove our marriage statues here in the USA? We never file and get a marriage certificate here. But legally, we are married couple.

    Thank you for any advices.

    Your divorce from a court or valid authority in Taiwan is good for you in California. However, if you have any joint assetts in US, that can not be addressed by a court outside the US.

      Thank you for your reply. You sounded like if we could agree to all issues on the joint assets, we don't have to settle this in the US court. Do we need to write up some kind of agreement on these joint assets? These issues will definitely be addressed in the divorce agreement while we file our divorce in Taiwan.

        I believe California is a community property state. That would mean marital assets are equally distributable between the parties. You need to consult a good divorce lawyer on how you could work out the settlement agreement out of court and get it drafted, notarized. If possible, have a judge approve the agreement with signatures saying no party can claim alimony or other debt shares after that date.

          My wife is willing to sign the quitclaim deed for our house. If the form is notarized and submitted to the county for registration. Will it be valid?

            Yes, quitclaim deed is valid. Make sure you mention a payment of $1 or something on the deed. Consult an attorney. A real estate one would do it for $200-$300 or less.
