Hello guys, I talked to IRS today and following is the information I have:
My scenario: Wife never been to USA (but has a H4 visa stamped), married in 2012
My options:
1. Get her passport certified by issuing agency, get a letter signed by her saying that she would like to be considered as resident alien even though she is a non-resident alien, and submit tax return along with her ITIN form to ITIN office
2. Get her original passport, get a letter signed by her saying that she would like to be considered as resident alien even though she is a non-resident alien, and submit tax return along with her ITIN form to ITIN office
3. File separately for now, amend the return once my wife is here to file jointly.
Let me know if any of you think my opinions are wrong or if you have better option
Standard disclaimer: This is not a legal advice, but just my understanding. I am not responsible for the statements mentioned above. You can contact IRS at 1-800-829-1040 for more info.
