  • Tax forms to fill out in my case?

    Hello,

    I have few questions on tax like what forms I should fill in out. I think there might be a couple of people like me who are in the same situation.

    I came to USA on December 14th 2009 on F-1 visa status and I completed my Master’s from USC (Jan 2010 – December 2011). Then from January 2012, I started working in a Company where I was on the OPT from Jan 2012 – September 2012 and same company filed an H-1B for me and from October 2012, I was on H1B status.

    Now tax season has started and I am supposed to file Tax returns. I am not sure what forms I am supposed to fill out.

    Can anyone provide some suggestions or thoughts?

    I am Single.

    You were a nonresident for 2012. You would file the 1040NR and Form 8843. You should of filed Form 8843 for each year going back to 2009 even if you earned no income. It would also help to know which country you are from, as some countries have treaty benefits. Also, did you have any other income, like investment income?

      Thanks greg for the suggestion. I am from India. I was in the impression that I need to file- 1040NR-EZ form. But you suggested I need to file 1040NR form? They both are different? And I am investing in 401k since I joined my company in January.

        The 1040NR is five pages instead of two, it is just a longer form with more information. If you qualify for the 1040NR-EZ (see the instructions) you can file it. Since you are from India you can claim the treaty benefits for the standard deduction. See pub 519 on how to do so.
