I am an Indian resident and I worked on OPT from Jan 2013 - Sept 2013 and then on H1B. My income was $75000 in 2013. I did not pay any FICA taxes on OPT and I have been paying them properly on my H1. I decided to get the help of a tax consultant to file my taxes as I have file taxes to 3 states and I was told by my tax consultant that I was on Dual status in 2013. Because I was on dual status on 2013, I was told I am not eligible for a standard deduction and I have to go for an itemized deduction. Frankly, I have nothing that I can itemize on my taxes as my employer covered my relocation and other additional expenses.
Is this really the way it works - a person on OPT and H1B the same year cannot go for a standard deduction? Also can you please suggest which form I should use - 1040 NR or 1040 NR-EZ or 1040 EZ? Would you suggest an online tax filing tool or a tax consultant for my situation.
