    Hi,

    I am a j-1 alien physician and my wife is a j-2 dependent. She does not work and does not have a SSN. We have been here since June 2014 and I have a few questions regarding the upcoming tax filing. I would very much appreciate if someone could help me out.

    Does my wife (j-2 dependent) have to fill any form? Based on what I found online I understand both she and I have to each fill form 8843. I also will have to fill form 1040NR. is this correct?

    In form 8843, will she only fill the first part and leave all the other categories blank? Since she is not a student or trainee or athelete nor has any medical condition?

    As she is my dependent, does she remain a non-resident alien until I become a resident alien? Or does she have a separate substantial presence test? will she be considered a resident alien since she has been in US for more than 183 days in 2014 or will she remain a non-resident alien since she is my dependent and I am not eligible to be a resident alien until 2016?

    A separate question, can I claim the flight expense for both my wife and me to come to US as moving expense in my 1040NR ? Even though its not 39 weeks? What proof do I need to submit along with the moving expense request?

    Dr. Rizwan,

    Both you and your wife are exempt from the Substantial Presence Test as long as you are both in compliance of the terms of your visa.
