Hello guys, I wonder if you can help me answer a question.
My wife has an H-1B1 visa and I have an F-1 Visa, do you know if we can we fill our 2016 taxes as ‘Married filing jointly’ and be eligible to claim education credits?
We have been living in the US since Jun 2nd, 2013. When we came to the US, I had an L-1 visa (from Jun 2nd, 2013 until August 15th, 2016) and my wife had an L-2. During all that period we used form 1040 with Filing Status: ‘Married filing jointly’.
But on August 15th, 2016 my wife changed to an H-1B1 visa and I quit my job to study with an F-1 visa. I’m not sure if we are still considered resident aliens for tax purposes when we fill 2016?
