You are both non resident aliens, assuming you are complying with the terms of your visa. On Form W-4 and the state equivalent, state that you are single to get the appropriate withholdings

Either tells your employer to withhold the same amount

However, the instructions clearly state "If married, but legally separated, or spouse is a nonresident alien, check the “Single” box"

So go ahead and check the single box
