    I work on H1B visa and my wife is on H4. I was living in VA for the first 5 months of 2006. Then I moved to another state. But my employer did not change the address on my paystub. He says that he needs to have a office in the new state so that he can show my new address on the paystub. As a result all my paystubs and W2 form have my old VA address on them. Now I want to apply for my wife's ITIN along with my tax returns.
    My questiosns are:
    * Will I be in trouble because of this situation?
    * I don't think that my employer will be forming a new office my state. So can I just continue showing my old address for the year 2007 as well?

    Any help will be much appreciated.

    As if any of us are ever gonna get green cards. Even if we do, there will be new laws on a green card e.g. you must be making at least $100K per year to keep the green card valid, you need to be living 355 days a year out of 365 days to keep the green card valid (currently you need to be here 6 months every year to keep GC valid), you would need to pay 45% extra tax if you are on green card.
    Its better to make as much money as possible while you can. Who knows what tomorrow may bring.

      If you changed your home address, notify the IRS to ensure that you receive any refunds or correspondence.

      Typically when you move you need to inform IRS about this address change either by Form 8822 or through income tax file return.



      In your case, more than tax it may be immigration related issue. I am suspecting LCA related issue because of which your employer is not changing the address.

      If you apply for ITIN, it will be sent on old address by mail. Do get immigration professional advice on this for legality of this.
