  • Social Security retirement benefits

My Social Security retirement benefits payments ceased upon my incarceration in a state prison for a felony conviction. I was released on parole and transferred to the Immigration detention, where I spent one year before getting deported.
I understand I can't get paid during incarceration in the state prison and from the day of my removal (deportation), but am I entitled for these payments during the year after incarceration and before my removal, which I spent in Immigration detention in a county prison?
My second question is whether, or not any member of my family (all americans, never left the country) can now begin to receive my benefits?

    Thanks, L.P.

You can get Social Security retirement benefits as early as age 62. However, we'll reduce your benefit if you retire before your full retirement age. For example, if you turn age 62 in 2020, your benefit would be about 28.3 percent lower than it would be at your full retirement age of 66 and 8 months.

Social Security retirement benefits are a vital financial support system for individuals who have reached the eligible age to retire. Funded through payroll taxes, these benefits are designed to replace a portion of pre-retirement income, providing financial stability in later years. The amount received is based on an individual’s lifetime earnings, the age at which they begin claiming benefits, and the total years of contribution to the system.

You may be entitled to receive Social Security payments for the year you spent in immigration detention, as benefits are not automatically stopped during detention in a county facility. However, they are not paid during incarceration in state or federal prisons for felony convictions. As for your family, they may be eligible for dependent or survivor benefits based on your work record, but they cannot receive your retirement benefits directly unless they meet the specific criteria set by Social Security.
