    Hello all,

    I could do with some much needed advice.

    Just to get you up to date with my situation - I left the USA in December 2019 due to a marriage breakdown. I made the incredibly hard decision to leave because I wanted to be with my family as I had no one but friends in the USA.

    I visited a week at the end of January 2020 to finish up gathering my belongings and tie up some loose ends. Since then I haven’t been back and the divorce went through - everything has been good since.

    So here’s the kicker - I have not given up my green card yet, there’s no particular reason for this, I just never got round to it and I’ve been looking into it recently as it keeps popping up in my mind.

    As far as I can remember I did NOT file any tax return in 2020 (baring in mind I was working in the USA up until December 2019). Also I have not looked into or done any tax returns since I left.

    Is this likely to cause any complications on returning to the USA when on vacation at the border? If so what would you recommend I do at this point?

    Keep in mind that you continue to be subject to US taxes on your worldwide income, and if you have more than a minimal amount of worldwide income in a given year, you are required to file US tax returns.

    Having filed US tax returns also helps to argue that you have not abandoned residency, if you are trying to enter the US as a permanent resident.

      What would be the right course of action in this case?

      I’m not looking to move back to the US but feel as though it would be wise to check to see if there’s an outstanding tax issues before I visit on vacation.

      Do you know if this is something the IRS can deal with, if I were to contact them?

        If you are not moving back to the US then why don't you file I-407 to definitively relinquish permanent residency?

            Hi,

            I filed I-407 as I was in the same position of Joe (I am living in Europe now and I filed from Europe)
            However I don't know how to check the state of the submission, I only know it was delivered.

            I doubt Uscis will send a notice oversea, what should I do to check that the abandonment process is completed?
