    Hello,

    I am getting married in December and my wife unfortunately will not be able to come along with me to US. Is there any way of filing joint tax return for this year?

    Oops, and how can I forget to mention that I am on work permit Visa.

    In order to file joint return, both spouses need to sign the return. You may be able to do online tax return where both spouses sign electronically.

      You can file jointly but you may not claim an exemption for her unless you are a resident of Canada, Mexico or South Korea.

        Thanks JP, Immihelp. What I have been told is it's feasible as long as one of the spouse is USA resident for the same year. I have been given following instructions...

        Your application must include all of the following.
        1. Your completed Form W-7.
        2. Your original, completed tax return(s) for which the ITIN is
        needed. Attach Form W-7 to the front of your tax return.
        3. The original documents, or certified or notarized copies of
        documents, that substantiate the information provided on the Form W-7.
        The supporting documentation must be consistent with the applicant?s
        information provided on Form W-7. For example, the name, date of
        birth, and country of citizenship must be the same as on Form W-7,
        lines 1a, 4, and 6a.

        JP, I am an Indian citizen, so will it be an issue if I get W-7 form filled and signed by her and file my joint tax return ?
