Hi All, Hope I can get some advice concerning residency requirements. I have not found a thread that seems relevant to me, sorry if there is and I have missed it....I have funds in place and an investment in mind that fits all the E2 requirements. I know that British citizens have to be residents of the UK to apply for E2. That's where I am a bit confused....
I am a British citizen, based in the UK, however due to various unforeseen personal circumstances I have had to quit my job and leave the UK and help take care of terminally ill family members. I have been away from the UK (not including holidays) for the past 2 years. I had only intended to be away for 3 months, but circumstances have meant I have been away 2 years. I am now preparing to go back to the UK.
During these 2 years all my UK outgoings have remained in place, I have retained my UK mobile phone, my mortgage payments, my storage unit, my bank account is still in the UK, and my funds are in the UK. However there have been no tax payments in the last 2 years (I have not been working), no council tax ( I have had to rent my flat out to cover the mortgage), no utility bills on my name. All of which I understand are what the embassy look at when determining residency. (tax records,bank statements, mortgage, utility bills, council tax)
It's clear I have not been in the UK for the 2 years except a few months on holiday. However as my 'base' has always been the UK, and I have always intended to return to the UK; ie I did not move abroad for immigration rather for family reasons on a temporary basis, and I was intending on moving back to the UK; does this make a difference to the US embassy in London when applying for an E2 visa? Or do they see things more black and white - that you have not been in the country therefore you are not a resident regardless of your links to the UK!?
I have located a business that is exactly what I have been looking for, and I would like to spend as little time in London as possible, (as I'm quite sure the current owners are not prepared to wait more than 3-4 for me - which is the usual US embassy in London processing time).
Also - If I do have to stay in the UK - how long would that be for; to once again establish residency?
Any advice would be welcome...
