  • E 3 EXTENSION Advice Needed.

    Hi guys, this is my first visit to this site and based on data provided, I must admit that this site is very informative and helpful. I take this opportunity to present my query here and seek advice's from the respected members here regarding my 1st E3 Extension.

    We (myself Indian origin Aussie Citizen & my wife, Indian citizen) got our E-3 visa in May, 2014 in Melbourne and came straight to USA and started working ever since. Our E-3 visa is valid through June, 2016 and we are planning to extend our stay beyond 2016, thanks to my employer who is very much willing to extend my employment.

    Our situation is that we have to visit my wife's family in India during April, 2016. We are intending to get our extension during our India trip in India. Based on the information provided by peers and expert advisers here, I presume that we can apply & get an E-3 Extension in India. I am wondering whether it is still the ideal case in our scenario.

    I presume that as we will be leaving mainland USA, in-order to re-enter, we must have a valid visa in the form of an extension. If that is the case,

    1. as we have planned our India trip in April, 2016, can we seek an extension from any US Consulate based in India?

    2. Or should we go all the way back to Australia and seek our extension?

    3. If we can attend from any US Consulate in India, please suggest us the ideal Consulate and the time frame it would take to complete the entire process.


    Also, I presume the paper work I need to take with me for an extension is pretty much the same documentation I took for my E-3 Visa. If I should take any extra documentation with me, please let me know.

    So peers, please advice me on the above requested so that I can plan ahead.

    I am same like u madhu. I am Aussie and my wife is with Indian passport. So what u can do is complete DS160 and schedule an appointment in May within your (City, India) US consulate for a VISA stamping (renewal if it same emloyer or new visa if it is new emplyer).
    and get E3 visa stamped. Travel to USA in June or July with newly stamped E3 VISA. U cannot enter to US with out valid VISA from India remember tat. Within US u can file for petition to extend your E3 work permit but for VISA stamping u need to go out of country to get it that is default rule.

    For 3 VISA inetrview
    1. LCA letter (Job Title should match ur current work)
    2. Offer Employer from your employer
    3. Degree certificate supporting ur job
    4. Work Experience matching ur Job description
    5. W2 last year
    6. Last 5 Pay stubs from your employer

    NOte: Always ur job description, LCA, Resume should match your current working profile with company and always say you will be returning to Australia and will be staying only for a period of two years.

      Appreciate your advice. It's very informative. I agree that I should file my DS-160 application with onshore Indian US Consulate and take with me

      1. LCA,
      2. Offer letter ffrom Employer (it's the same employer whom I have been working with since 2014),
      3. my educational certificates,
      4. my work experience (I presume my work resume will be enough),
      5. W2 &
      6. pay-stubs from the last 3 months prior to my extension.


      I must admit here that we have only planned 3 week trip to India. So sticking to the same travel plan, 1 thing that is concerning me is, can we attend the Consulate immediately we land in India with all the above mentioned documentation, get our extensions approved, receive our passports back with the visa stamped and catch our return flights back to USA as we planned?

      Did I consider every aspect of getting an E 3 Extension properly? Have I missed any small information?

      Most importantly, is seeking an Extension from India a good idea?

      Or, should I visit countries bordering mainland USA and seek my extension from one of those Consulates?

      I am also stuck with one thing ( I know this may sound stupid of me but, don't know whom to ask) which is, do all Consulates handle E 3 visas around the world or only few?


      Please advice me in this regard.

          I situation is similar to you, Aussie with Indian wife. My wife E3d was issued at Hyderabad.

          I haven't applied for extension yet, but unlike you i am planning to stay in the country and apply extension through USCIS with out going out of the country for stamping. Even if i get the extension and leave the country on a holiday I need to go through the whole process of interview and stamping again.

          Now to answer your question most of the countries will processes E3 visa with some exceptions like Jamaica. As you asked if going for E3 stamping in India is safe bet?. To be frank you never know, They might ask you to provide documentation for "Ties to Australia". I personally never knew a person who applied for extension in India before, but I have heard about a person through a friend who got his visa rejected for E-3 extension in CANADA, This is usually rear.

          To my knowledge the only reason they may reject(Which is long short and you never know if you have a bad day) your extension, Is if you fail to show ties to Australia. My suggestion is that just take few Aussie documents such as your Super-annuation Statement, Aussie drivers License etc. I know these documents doesn't weigh much but they are something to show for.

          As for which US Mission is safe for stamping, you never know, it depends on the counselor who is interviewing you. So do stress out on which mission to apply , just pick one which is convenient for you. Remember you need to go to the consulate two time for your interview , they take a picture and finger prints a day or two before your actual interview. So if you don't live in Delhi,Mumbai,Chennai,Hyderabad or Calcutta, Make arrangements to stay for 2-3 days.

          Best of luck and please follow up on you experience so that it can help others.

              Hi madhu8354,

              You must need a valid VISA to enter into the US, if you got approval for extension, that is not considered a new VISA (every visa has an expiry date). An extension is valid when you reside with in the country, once you travel out and reentering into the US you must need a valid visa. If you don't wish to apply new E3 visa in India then I think you can get stamped in Canada, I have done mine in May @ Ottawa, Canada.

              I heard from friend of mine that if you apply for an extension with USICS, it may take anywhere 4-12 weeks.

                E3 extension in India

                You can get it stamped in India, absolutely no issue, I did many times in India.

                If it is first time you are getting E3 visa then it has to be in Australia, all subsequent E3 you can get it from any country.
