  • E3-D working from home for a foreign company

    Hi,

I cant seem to get a straight answer out of anyone. My wife has been working from home for the same company in Australia for 10 years now. We have lived in Australia, South Africa and now the USA. She will not working with any clients in the USA just working from her laptop processing work for a company with no presence in the USA.

Does my wife require an EAD (I-765) in order to continue working for her Australia employer from home in the USA? I have heard both yes and no. I heard NO as she is not working for an American company and is based at home. I am hoping this is correct.

    Thanks so much.

    Hello,

To work in the US, you need an EAD no matter if you are working for an international company. You are still working over here. It is part of your process towards a greencard. If you don't apply for a EAD, that might complicate things later. I had to do the same thing.

    Thanks,

    JV

      Thanks so much JV.

So were you working for an international company that was not dealing with clients in the USA? So purely working from home on internet processing data capture for clients from overseas. The company does not have a presence in the US.

      Thanks.
