E2 visa & dual intend

My unmarried son 22 year old has denied US visa F1 2 times & B-2 once due to pending F4 petition for parents. Now he is not the beneficiary of parents petition . Can E2 visa may be refused to him due to duel intend.

E visas, just like F & B visas, require the applicant to overcome the presumption of immigrant intent

If he is an Indian Citizen he is not eligible for E2 Visa. Nonetheless having an immigrant application pending for a parent does not preclude a dependent son or daughter obtaining another type of visa they could qualify for.
