  • E1 grace period - how long can I stay

    Hi,
    How long is the grace period to stay in the US after the employment on an E1 visa has been terminated.
    Any help is appreciated.

    I have the exact same question. Does anyone have an answer to this question? I would really appreciate it if someone could answer this.

      I asked this question to my attorney, here is the answer:
      "There is no grace period. Once it expires, you will have to leave."

        if your E-1 is about to expire (say at 4 years and 11 months), you may eventually enter USA just a month before the 5-years deadline, and claim (if asked at POE) that your E-1 renewal is actually being processed at your country's US embassy (where you come from), but you haven't received validation yet.

        The officer can not refuse to let you in (since you're a manager and essential to the business' survival) and he will likely grant you another round of 2 years (it's become a protocol), making it a total of 5 + 2 = 7 years of stay, even though your business might not even exist anymore or just got bankrupt (that's borderline though, but a loophole).
