  • how is I-94 date decided

    Hello Everyone,

Basically any idea on how the I-94 stamping is decided? Like, I have a visa expiring Feb, 2013. and I-94 is upto Sep, 2013. If I travel say in the month of December this year and return back after 2weeks, what would be the next I-94 date? I mean will it be like same Sep, 2013? or Dec,2013?

I heard normally the date for L1 I-94, is given by default as 1year....but am not sure.

    thanks everyone

There are no definite guidelines but they consider passport expiry, petition expiry and visa expiry into considerations. Normally L1B I-94 are given for 3 Years if passport is not expiring in the next 1 Year. But all depends on the Visa Officer at the POE and at their discretion an I-94 can be given different from the passport expiry/petition end date/visa expiry and decide solely on the basis of your answers at the POE to their questions.

This is my opinion not legal advice.
