    Guys,

    Confused and need help!!!..

    I have L1B Blanket Visa valid from 2008 Feb to 2011 Feb.
    I travelled to US in 2010 Feb and got I94 valid from Feb 2010 to Feb 2013 (3 yrs.)
    Wife joined later but got I94 only upto the validity of my visa (2011 Feb).

    Company filed for an extension for her I94 based on my I94. I submitted a form called I539 for that and her extension was approved
    until the end of my I94 (Feb 2013). I also have received an EAC number for a dependent petition.

    We both came back in Feb 2012.

    1. Did they just extend her I94 or my petition also got extended until Feb 2013?
    2. My petition says valid indefinitely. Where can I see the validity of my petition? (End date etc)
    3. If my petition also would have got extended until Feb 2013, can I extend it further and make use of the same petition or do I need a new one??
    4. what is the difference between Dependent petition numbers Vs mine??
    I see a different EAC number for dependent petition than what they have mentioned on I539 form for the question
    "Is this application based on an extension or change of status already granted to your Spouse, Child or Parent"

    Please help...

    Petition, Visa and I-94 are different things. Petition is the formal request for a green Card or specific immigrant/temporary visa. After petition is approved the immigrant can submit the visa or GC application. Once Visa is approved, the immigrant is allowed to enter into US till the last date of the Visa. Upon arrival in US one is granted an I-94 which decides the time period one can stay for that trip in US.

    Petition end date need not be the visa end date and visa end date need not be the I-94 end date.

    1. I539 is submitted requesting for extension of stay i.e. extension fo I-94. So in your case since you submitted request for extension of yoru spouse's I-94 only her I-94 has got extended.
    2. L1B petitions generally are valid indefinitely there should be a place holder for petition end date and it generally says indefintite for L1B.
    3. Why would you want to extend a petition which is already valid indefinitely. With that said, having and indefinite petition end date still doesnt extend your visa or I-94 as they are all different things.

    Even though you and your dependent have a valid I-94 till feb 2013, if you leave US, you would need to get a new visa in order to re-enter US.
    Even if your petition is valid indeifnitely you would need to file for extension of stay for you and your dependents to stay beyond Feb 2013. Again even if extension of stay is grante dit will only extend your I-94, in case you want to leave US and re enter you woul dneed a new visa as your current L1 has alreayd expired in 2011.
