  • L2 status if L1 is denied

    Hi,

My L1-B to L1-A conversion petition is under process with USCIS. My daughter is on L2 as my dependant. In case if my petition is denied can she continue to stay in US under my husband's petition/visa? My husband is on L1-A that is valid till May 2013 and my daughter has I-94 that is valid till May 2013.

    Thanks in Advance

    Regards,

If your current I-94 has ended, the petition denial will make her out of status. Otherwise, you will remain in L1B status and your daughter can remain as your dependent.
This is my opinion and not legal advice.

Thanks kabkaba. Both our I-94 is expiring on May 2013. So, can she continue to stay in US till May 2013 even if my L1-B to L1-A gets denied as my husband is on valid L1-A status till next year? I should get my decision within two weeks from now.

      Thanks in Advance
