  • Applying for 2nd L1 Visa - different company

    Hi,

I'm currently looking at getting another L1 Visa.

I worked in the US for my previous company in 2010. The L1 Visa I had then expired in June 2012.

I heard that when you renew an L1 you get an additional 5 years. Does this only apply if you're still working for the same company?

I was reading through the list of documents I need for the application and came across:

"Any documents pertaining to previous H-1B or other petitions or applications filed with USCIS/INS (including receipt notices, petition forms, letters, approval notices, visas, I-94 cards), if any."

I can't say for certain whether I have any of the documents I used had for my initial application. How important is this?

How long were you in US with previous employer? When did you leave US? How long have you been working with the present employer. If you have been working for the present employer for at least 1 Year in past 3 Years you can certainly apply for a fresh L1B from current company and the new L1 once approved will be valid for 5 Years.

Am sure you would be having at least some documents with respect to your previous travel on L1. I dont think its mandatory to have but its good to have.

This is my opinion not legal advice.

I worked in the US from July 2010 to Dec 2010.

I'm working with my current employer for 134 months and I do have documentation relating to my previous L1.

So even though it's a different company the extension of 5 years still applies?

I am confused, if you were with previous employer till Dec 2010, how you can be with current employer for last 134 Months? Assuming you quit in Dec 2010 it was only 22 Month back, thats only about 100 Weeks, my math may be poor but it doesnt add up.

Anyways, if you are with the current employer since Dec 2010, and have been outside US for more than 1 Year then you are eligible for a fresh 5 Year L1.

This is my opinion, not legal advice.

          Sorry I'm meant 13 months.

Going by what you said I should be eligible for the 5 year refresh.

          Thanks for your advice.
