  • L1 visa question

    Hi all,

I am a brit and have been given a few job offers. One of them is to move to the US to work for a new US company (under 1 year old). They say they will hire me in the Uk and transfer me over to the USA on a L1. Would this work? Wouldn't I have to have worked for the 1 continuous year before moving? What other options would they have? It's a very small company.

    Thanks for your help!

You are right, you should work for their overseas subsidiary that is at outside US office for at least 1 Year in the last 3 Years in order to be eligible for L1. They can start your H1 processing in April 2013 and you can work in US from 01Oct 2013 after H1 approval. In either case you can reach US only after 11-12 Months provided your visa is approved. H1 will certainly be faster and easier route. The reason they may not want to do H1 is once in US, one can easily inititate a H1 transfer and shift jobs which is not possible while on L1 as L1 cannot be transferred to another employer.

This is my opinion not legal advice.
