  • Regarding EAD renewal

    Hi,

    Currently I am on L1B, expiring on Oct 2013. My I-94 expires on the same day. My wife is on L2 and has got same date of I-94 expiry.

    My wife got EAD card on Feb 2011 with expiry date of Feb 2013. If I go for EAD renewal, will USCIS renew it with new expiry date of Oct 2013 or they won't ?

    Yes, your wife can renew it up to the new i-94 date.

      What do you mean by new i-94 date ? Do you mean the new i-94 which I might get after my visa extension or current one (i.e. Oct 2013 ) ? Pls clarify.

        Whichever is the latest as of the date of EAD application.

          The same thing happened with me as well. My L2 EAD had an expiry date 9 months before my I-94 expiry. When I applied for renewal, got a RFE asking for proof of my husband's I-94/ petition extension. Finally I wrote them a letter explaining the whole situation and asked them to renew the EAD for the remaining 9 months of my current I-94 validity. They did that and now I have to apply for a fresh EAD extension basis the approved L1 extension petition. Ask your wife to do the same, shouldn't be an issue.
