L2 Expire on Mar-31

    Hi,

    Right now i am in USA on L2 Visa. Both my spouse's L1 and my L2 visa are expiring by 31-Mar-2013. I got EAD for L2 and working for Employer A (EAD valid until 12-Apr-2013).

    I entered here in last week of november 2012 and i got the I-94 where the immigration officer mentioned the expiry date as "Until L2".

    We are not expecting my spouse's employer will go for an L1 extention (Employer B).

    Given this situation my question is

    One another employer (Employer C) is ready to make H1 for me as soon as 2013 CAP is open in Apr-2013.


    1) Can i stay here until i come to know the result of whether my H1 petition is approved or not? (At-least up to end of Apr-2013).

    2) If yes then can i start working for Employer C as soon as they get my H1B papers or i need to wait until Oct-2013?


    Looking for some advice.

    1. No. You can stay only till your I-94 validity.
    2. You can start working on H1 only from 01-Oct-2013 or later if H1 is approved.

    Based upon what you have mentioned, unless your spouse's employer files for L1 extension and its approved I am afraid you will have to leave upon yours and your spouse's I-94 expiry.
