  • Regarding responding to RFE on L1-B extension

    Hi,
    My company filed L1-B extension on Oct 19th, 2012. And my petition received RFE on Nov 1st, 2012. I have responded to my Company's case manager with necessary RFE documents on Dec 6th, 2012. I got update from Case Manager that my RFE is due in January and they will review the RFE docs in 2-3 weeks. And in few FAQ's documents, I read that company usually submits the RFE document prepared by Attorney 1 week before the RFE due date.

    My I-94 expiring today i.e, Dec 17th, 2012. In this case, is my stay going to be legal as my case is still in progress. I have seen few answers in this forum that if I-94 is already expired or expiring soon, better to file for Premium process. Isn't the stay while the petition process is In-Progress going to be legal? Appreciate your answers. Thank you.

    You can stay upto max 240 days if your Extension was filed before I-94 expiry:
