  • L1 to H4. How soon should i resign

    Hello,
    I am currently working on L1B and my spouse is working on H1B. I only have few weeks left on my visa. So i wanted to resign my company (want to work till last day on L1B status) and change the status to H4.
    I wanted to know how many days prior should I resign my company. Is there any period like 2 weeks in advance for employees on L1B. or can I resign just before 2 days of my visa expiry date?

    Also how many days prior should i apply for H4 COS.

    I would assume you would want to give proper notice period to your organization. Generally it is two weeks. You can and should file for COS to H4 before your last working day.

      You can resign at any time after filing change of status. Change of status must be filed before I-94 expiry and before last day at work. Two weeks notice is standard, check with your employer if they have a different policy and check any contracts/agreements that you may have signed with them.
