  • Will my existing H4 be cancelled if L1 is rejected/denied?

    last week I got my H4 visa stamping done at delhi Consulate and I was planning to join my spouse in the next coming weeks as dependent. Now, my employer wants me to apply for a L1-b visa stamp by next week and wants me to work in US.
    Now my concern is - will the US Visa consulate reject my current H4 visa stamping at the time of issuing a new L1- visa stamp in my passport.

    Also for some reason, if my L1 visa stamp request gets denied will they also cancel my current H4 visa stamping as well.

    Though possible, it depends on the visa officer, but generally they dont do it. You can hold both valid H4 and valid L1 in your passport but when you enter US you have to declare whether you are entering in H4 capacity or L1 and provide documentation accordingly. If you enter on H4 then you cannot work, if on L1 you have to work with the L1 employer and get paid. While in US you will have to file a COS in order to change from H4 to L1 or vice versa.

    Also, if they deny you L1 you can still have H4 in your passport.
