First of all Happy New Year to everyone.
I need some advice but before that let me explain my current status.
1. I worked for company-X in India for 4 yrs on technical ladder and then company moved me to US on L1-B as Systems Architect (this was my position in India as well). I was working as individual contributor with no management responsibilities.
2. I came to US on L1-B in Nov'2011. My L1-B is valid until July 2014 (this is 1st L1-B). I have traveled outside US couple of times while on L1-B last yr. My company promoted me to Director position of my organization with technical and management responsibilities with power to hire/fire and reportees in Europe, India and US in Dec' 2012.
3. Since my company has policy of applying for Green Card for people who have completed one yr in US hence I am eligible for it. Now, I would like to seek advice what's best way for me to go for it. Please see below.
4. Shall I anyway change my visa status from L1B to L1A in US because I am now in management position? Am I qualified for it given above details (I was not manager in India). It's just one month since I am holding this position in US.
5. Can I qualify to apply for Green Card under EB1 category (either directly from L1B or if I qualify and get L1A then through L1A as I hope that will be fast way to get Green Card)? Is there any restriction?
6. What if I convert L1B to H1B? Can I still apply under EB1 category while on H1B on the basis of my management position?
I am totally confused and don't know what to ask/suggest to company. They are open for all options which is legally possible to help me as they want me to continue long term here.
