Similar issue has been discussed in this forum many times. But still I want to post my case to get expert opinion.
I joined in my current organization 10 years back. I worked as a manager in India for last 5 years. I moved to US in the same organization head quarter as an engineer two months back. My current role in the organization is of an individual contributor. I came in L1B visa.
My employer is planning to apply for GC. Can my case be eligible for EB1 category?
In USCIS web site I found that they don't explicitly specify the current role (does "continue service" below means it has to be continued in the same manager role?)
"You must have been employed outside the United States in the 3 years preceding the petition for at least 1 year by a firm or corporation and you must be seeking to enter the United States to continue service to that firm or organization. Your employment must have been outside the United States in a managerial or executive capacity and with the same employer, an affiliate, or a subsidiary of the employer"
Any help to clear my understanding will be appreciated.
