  • L1 B Visa - Canada Stamping

    Hi,
I have my L1 B Visa stamping in Toronto,Canada this month end.
I'm planning to travel in my own car to Toronto.
My question is Will the officials at the border crossing take the current I-94 and give a new one when I'm re-entering ?

You will have to ask the Canadian officials to take your I-94 off when you enter Canada. That way when you return to the US, they will give you a new one. This is optional if your I-94 is valid for some time in the future.
Keep in mind the risks, if your Visa is denied you will not be able to return to the US directly unless your current Visa is valid and if it does not get canceled. You will have to go to home country from Canada.
This is my opinion and not legal advice.

      Thanks for the reply.
My situation is like currently i'm on L1 Individual and my visa and I-94 expire on March 16, 2013.
My employer suggested going for new L1 Blanket with Canada stamping instead of filing for current L1 extension.
So if my new L1 B is rejected, will I lose my current L1 visa stamping also, since it is valid till March 16 ?

They may or may not cancel your existing Visa, that depends on the consular officer's discretion. If they don't you will be able to return to US, if they do you will not be able to return directly.

No one can predict the same, sometimes they cancel the existing visa before issuing a new one (you can always request not to do so, but its up to the officer) In case they deny a new L1B but don't cancel the existing one you can enter US till March 16, again while entering US, you might get an I-94 matching March 16th or maybe till later. Again depending upon the POE Officer.

I am copying below what another Forum Member posted in a different thread for Canada stamping:

          Read this on US embassy webpage;

Consular officers in Canada will likely refuse to issue a visa to first-time student or work visa applicants if their education and/or work experience is solely or predominantly from a country other than the United States or Canada. Note also that there are some risks associated with applying for a visa in Canada. If the consular officer does not approve the visa, the applicant may not be able to return to the United States. Even successful applicants may be required to stay for an extended period until a decision has been rendered. Please consider all these expenses and time delays before scheduling an appointment.

This is my opinion not legal advice.

                Hi,
My visa got approved and I came back to the US this weekend.
Got new L Blanket with 5 yrs validity. The interview in Toronto was fairly simple and the officer asked only few basic questions and approved my visa.
It took 3 days to deliver my passport.

                  Hi,

                  Very useful information.

Can you tell us how many days before should we go for L1B new visa stamping into canada.

We have l1b visa valid until Nov 2013.

Hi vmurali21, what day you got interviewed? Monday/Tuesday? Basic questions like?

Reason, I ask is I will have my interview too next month. It is scheduled for Tuesday, if approved, I am hoping to get the passport within a week.

                    Thanks!
