  • L2 and EAD extension based on primary I-94 dates

    Hi,

I am on L1B visa, my wife is on L2 visa with EAD.
    Here are our dates

    L1B Visa expires - 25AUG2013
    L1B I-94 expires - 12JUL2015
My I129S is based on a blanket petition which is valid indefinitely. My last date of employment in I129S is 25AUG2013

    L2 and EAD expires - 25AUG2013

I know I can apply for a I-94 extension for my wife based on my I-94 using form I-539.
My question is can I also apply for EAD extension based on my I-94 along with I-539? If yes how many months before the expiration I can apply for the extension 4 or 6?

    Thanks.

Yes, both can be filed together. I-539 is up to 6 months in advance but EAD if I remember correctly is only 3 months in advance. Your spouse can file both together 3 months in advance.
This is my opinion and not legal advice.

      Thanks for the reply.

I went to USCIS site on EAD renewal date

Looks like its 120 days before the current expiration EAD renewal can be applied.

In that case I will advise filing I-539 to extend status 6 months in advance so that you will get a decision withing 2 to 3 months and then there is plenty of time to apply for EAD renewal.
This is my opinion and not legal advice.
