L1B Visa expired but have valid i-94, can i file for my wifes COS from L1B to L2

  • L1B Visa expired but have valid i-94, can i file for my wifes COS from L1B to L2

    Hello,

    My L1B Visa is expired on Dec -2012 but i have valid I-94 till Jan-2015, My Spouse is also working on her L1B visa from different company, her situation is also same her Visa is expired on Sep -2012 and have valid I-94 till Oct -2014. Now the sitation is her Project is about to finish and company is asking her to go back to India. Is it possible for me to apply for L2B dependent Visa (COS) for my spouse depending on my valid I-94. What are the best options for my wife to stay in US without going back to india and filing new Visa.

    Any information is highly appreciated.

    You should be able to file I539 for your spouse to convert from L1 to L2.
