  • H1B to L1A?

    I am right now working on H1B in the US. I intend to take an exam in the next 2-3 months, that once cleared, will elevate me to a managerial position with my employer. Also worked as a manager in the Indian subsidiary of my employer in 2012, managing a minimum of 3 and a maximum of 5 people team in India.

    Would I be eligible to move to an L1A visa after I make manager with my current employer?

    Any particular reason for moving from H1B to L1A?

    L1A is not only about being a manager. USCIS seeks very stringent documentation for L1As. USCIS expects one to be able to take executive level decisions or to manage other professionals and be able to take decisions which affect the business in significant way. Just doing People Management of 3-5 people is generally not enough.

      If you have been in the position for the foreign subsidiary for the prescribed period (I think it is 1 year) and if the position qualifies for L1A, the petition may be approved. But this is an evaluation that your employer and their lawyer should do.
