L1B to H1 I-94 is getting expired on 15th Sep 2013

  • L1B to H1 I-94 is getting expired on 15th Sep 2013

    Hi guys i am new to this post, kindly help me in sharing your views.

    I am on L1B visa which is getting expired On 15 September 2013. This is my last extension on L1B visa because i will be completing 5 years of my L!B visa time. There are few question which i need to ask.

    1. Can i apply for a change of status from L1b to H1.

    2. If my H1 get approved,can i stay after 15th September 2013 the date when my I-94 is getting expired.

    3. Is there any other option to stay legally till 1st October, the Legal date to start woirking on H1.

    1. Yes. New H1 can only be applied on or after 01-Apr-2013.
    2. No. New H1 start date can only be from 01-Oct-2013.
    3. Convert to B2 or leave US and re enter on H1.

      Another option for 3 is to extend L1 status up to Sep 30.

        I dont know if that is possible as Sudhir mentioned he is completing 5 Years stay on L1 on 15 Sep 2013.
