L1B expired,applied for extension, waiting for the decision

Hello,

my L1B expired in jan 2nd week 2013 and the company applied for extension in jan 1st week 2013. I am waiting for the decision.
I got married during jan 3rd week 2013, here in US. my wife is on H1B.
If my L1B extension does not get approved then can i change to H4 status without going to India?

You can do a COS only when I-94 is valid.

If your I-94 has expired then in case your L1 extension is rejected you will have to leave US.

You may not need to go to India, you should be able to go to nearby Mexico/Canada to get H4 stamped.

can i go to india and get h4 stamped (with the marriage certificate) or does my wife need to accompany me in india for stamping?
