  • L1 Visa Acceptance

    Dear Senior Members and All,

    Me and my wife are working in two different Indian IT Companies. Our company's are initiating L1 for myself and H1 for my wife. My wife's H1 visa has been initiated and tentatively by end of March 2013 her visa will be filed. While my wife's visa is getting processed, I will be scheduling my L1 Interview in the month of May 2013.

    Can you please help us clarify with the following questions :

    1. Can my Wife apply L2 and come along with me for the interview? I heard from many that taking family along doesnt improves your acceptance chances.

    2. Will her H1[being processed in parallel] get affected anyway?

    3. I have been suggested by many people that the acceptance rate for L1 during April,May,June period are better [the logic being that the US immigration starts processing the H1 only by July - August, hence they do allow work permits in this lean period].

    Also, more background, I currently hold a B1[valid until 2020] on which I was in US from Oct 2010 to Jan 2011. In Sept 2011, I applied for L1 and was rejected mainly due to following reasons per my understanding:
    i. VO handed over me the Blue Slip i.e. not approvable and apply for H1.
    ii. I overstayed on my one and only B1 Trip[as mentioned aboved].

    Please assist and guide us.

    -- Yes, she can apply with you. It makes no difference to your chances.
    2. Will her H1[being processed in parallel] get affected anyway?
    -- No.

    -- There is no such thing. L1 Visa application will be made by you to the consulate (Department of State). H1 or other petitions are filed by employer to USCIS (Department of Homeland Security)

      - My I94 was valid from Oct 2010-Apr 2011 and I returned by Jan 0f 2011.
      I was there for some trainings and Project Planning.

          Thanks for Clarifying. I guess, have to focus mainly on documentation and go afresh for the Interview.
