  • What happens if H1B to L2 COS is rejected?

    Hi,
    I have applied for H1B to L2 COS and today I got the receipt notice from USCIS.
    My current I94 is valid until July 2013.

    What happens if the COS is rejected?
    Is it still OK to stay in US until July 2013? or Do I need to leave the US immediately?
    What will happen to my H1B status? Is it valid even after COS is rejected?
    Please help.

    Is it an existing h1 or a fresh H1? What were the dates of the H1 petition? What is the L1B start date end date? When is the L1B I-94 expiring?

      The denial notice will state if your current status is invalidated. If not, you can stay in the US as long as you maintain H1B status (by working with the H1B employer).

        Yes, it is an existing H1B valid from Oct-2010 until Jul-2013.
        I94 for this H1B expires on the same day the visa expires that is Jul-2013.
        I will be working for this employer for 1 more week only as i have resigned my job and on notice period.
        No plans to work after that. Planning to take a break.

        My husband's L1B/I94 expires in Mar-2014.
