  • How soon should i Leave . My employers not planning my return .

    My L1 B Visa has expired on 1-Jun-12
    I had Applied for extension 28-May-12 through our company attorney
    I Received RFE on 29-Sep-12 Expecting Reply back by 24-Nov-12
    I Replied back on RFE 21-Nov-12
    A Denial notice was sent on 7th Jan 2013 for the decision made on 12 Dec 2012
    As per the information i had gathered i should leave immediately, however my company is not planning for the return yet . I need to know how much can i extend my stay without getting into legal troubles. Thanks a bunch for all your help.

    If your I-94 has expired you should leave immediately. If it has already expired on 01-Jun-2012 you probably already have 240 days of out of status period and should stop working altogether.

    After denial notice and after the date mentioned in the denial notice by which you should leave US, the DHS can initiate deportation proceeding if you dont voluntarily leave. You will soon start having trouble reneweing your lease, insurances, licenses etc as you are accumulating illegal stay as you neither have a visa nor I-94.

    Even with all this if you decide to stay illegally its your choice. It may not be immediate legal problem but the longer the out of status and illegal period the lesser your chance of getting any US visa in the future.
