  • L1-A visa Query?

    Hi,

From 2006 to 2010 I worked with XYZ Company and from there I left that company and worked in ABC company from 2010 to 2012. Again I joined back in XYZ in 2012. There is a gap of 20 months between XYZ and ABC companies. Now my XYZ company wants to do L1 -A visa for me to usa. My question is am I eligible for L1-A visa, though I don't complete one year with XYZ again? Will the consulate accepts my application if I apply? I heard that there is a condition that I should complete one year with curent company or should be working since 3 years in current company. But no where it is mentioned that if gap is there we cannot apply. If anyone faced this situation please respond.

The requirement is ....been working for a qualifying organization abroad for one continuous year within the three years immediately preceding his or her admission to the United States....

So if you apply L1A today you should have been working for at least 1 Continuous year with XYZ between 08-Feb-2010 - 08-FEB-2013. If not, then advisable to wait till you complete 1 Full year with XYZ at the time of application.

This is my opinion not legal advice.
