company A L1A to company B L1A - is one year mandatory?

  • company A L1A to company B L1A - is one year mandatory?

    Dear Folks,
    I have a valid L1A Visa from Company A, I have now joined company B in india, now If I have to go for L1A visa again , should i wait for one year in India?
    By the way I have my L1A visa from two diffrent companies earlier for the past 5 years.

    Are you saying you have had two L1A visas stamped and active at the same time in your passport from two different employers? I think that is highly unlikely.

    But to answer your question, yes you would need to work for Employer B for at least 1 year in order to be eligible for B's L1A petition filing.

      Well actually it is not having two L1A same time with two companies, if fact there a gap of one year in both my previous companies.
      Now I have another question for you.
      Can't my current employer - Company B , directly apply for I-140 stating that it for future employment and then maybe after one apply for L1A?

        Yes technically they can but just having an I140 filed doesnt grant you valid entry into US, I140 approval can take many months depending upon your category.
