  • L2 Visa Stamping after extension of I797

    Hi,

    My husband is on L1 B Visa and it has expired in Oct 2012 but has a valid I-94 till Jan 2015.

    I had a L2 Visa expired in Oct 2012 and i -94 valid till Oct 2012. Later filed for extension of L2 Visa as my husband's employer sponsored only for my L2 extension but not for my husband. I got my I 797 valid until Jan 2015 along with i -94 valid till Jan 2015.

    Now i am planning to travel to India, so i definitely have to go for the Visa stamping. So the question arises here, will i be granted a Visa or not as my spouse doesn't have valid visa to stay in US but he has only valid I-94 until Jan 2015. Will i get stuck in India and will my Visa get rejected.

    Can anyone suggest me on this accordingly i can plan my travel.

    No one can predict whether your visa will be rejected or not. Its all upto the Officer and how you answer the questions. if you have the right documentation I do not see any issue.
