    Hi

    I have my L1a valid until Oct 2014. My company is neither ready to file GC in EB1C nor convert it to H1B. I will be completing my 6 yrs of tenure in April 2014.

    Can I look for other company who can file my H1B now? If yes can it be processed in premium and be effective before October 2013?

    I am checking if my H1B will be effective before Oct 2013 and new company files GC so that on Labor approval I can continue my stay.

    A new H1 can be filed on or after 01-Apr-2013 and the start date can only be from 01-Oct-2013 or later. Since L1 + H1 can only be for 6 Years, you will most likely get H1 only till April 2014. Premium processing will not help.

    You can start the GC processing at any time, if you can find an employer willing to file a GC for you even if you are not joining them till 01-Oct-2013.
